Federal Court Grants Stanton Witherspoon 90-Day Extension for Prison Surrender

Miami, FL – The United States District Court for the Southern District of Florida has approved an unopposed motion to extend the surrender date for Stanton Witherspoon, CEO of Spoon Network, to begin his 41-month prison sentence. Witherspoon now has until April 23, 2025, to report to federal custody, granting a 90-day extension from the original January 23, 2025, deadline.

Judge Rodney Smith approved the motion following a request from Witherspoon’s attorney, Annabelle Nahra Nadler. Nadler argued that the extension was necessary to allow Witherspoon to continue cooperating with federal authorities. At his November 2023 sentencing, the court acknowledged his cooperation but reserved the possibility of revisiting his sentence based on the outcomes of his assistance.

Nadler assured the court of Witherspoon’s full compliance with bond conditions, emphasizing his low flight risk and non-threatening status to the community. The motion was unopposed by Assistant U.S. Attorney Christopher Clark, who authorized Nadler to convey the government’s agreement to the court.

“Witherspoon has shown consistent cooperation, and the ongoing matters tied to his assistance are yet to be resolved,” Nadler stated. “Granting this extension ensures justice is served by allowing these efforts to reach their conclusion.”

Judge Smith described the extension as “reasonable and appropriate under the circumstances,” emphasizing the importance of facilitating Witherspoon’s cooperation.

Case Background

Witherspoon’s legal issues arose from his involvement in a high-profile federal investigation into wire fraud. On August 24, 2023, he pleaded guilty to conspiracy to commit wire fraud and was sentenced in November 2023 to 41 months in prison. The sentence also includes the forfeiture of four properties and a US$3.5 million fine.

The Department of Justice revealed that Witherspoon, a Burlington County, New Jersey resident, admitted to participating in a scheme that defrauded others through wire fraud activities.

Initially slated to begin his sentence on January 31, 2024, Witherspoon’s surrender date has been revised multiple times. This reflects the complexity of his case and the potential value of his cooperation in ongoing federal investigations.

The latest extension underscores Witherspoon’s continued collaboration with authorities and the possibility of further developments emerging from his assistance.
